1. Who operates Gina Heartwing

GinaHeartwing.com, the Gina Heartwing applications, games and related digital services are operated or intended to be operated by Heartwing Entertainment Ltd, a company incorporated in the Republic of Cyprus (“Heartwing”, “we”, “us” or “our”). Company registration and registered-office details will be published in the Legal Notice when incorporation is completed.

2. Acceptance of these Terms

These Terms govern access to and use of GinaHeartwing.com, play.ginaheartwing.com, Gina Heartwing applications, stories, games, creative tools, Wonder Worlds, the Heartwing Collection and other services that link to these Terms. By using the service, the relevant user and, where applicable, the parent or guardian responsible for a child user agrees to these Terms.

3. Children and parent or guardian responsibility

Children may use age-appropriate parts of Gina Heartwing, but account registration, purchases, consent to personal-data processing and use of external sign-in providers must be handled in accordance with applicable age requirements and parental-authorisation rules. A parent or guardian is responsible for supervising a child’s use where required by law or by the design of a particular feature.

4. What Gina Heartwing provides

Gina Heartwing is a story-led entertainment, learning-through-play and creative environment. Features may include illustrated stories, narrated adventures, puzzles, Wonder Worlds, Story Studio, Melody Maker, collectible content, Sparks, saved progress and other interactive experiences. Features may differ by device, country, platform or version.

5. Learning content

Gina includes activities that may support skills such as memory, sequencing, problem-solving, listening, creativity, planning, emotional reflection and persistence. Gina is not a school, tutoring service, medical service, therapeutic service or substitute for professional educational, psychological or clinical advice. No particular educational result is guaranteed.

6. Accounts and sign-in

Where accounts are available, they may be created using email or supported third-party sign-in services such as Apple, Google or other providers. You must provide accurate information and keep account access secure. We may use parent accounts and child profiles separately so that a child does not need to provide more personal information than is necessary.

7. Sparks, unlocks and virtual items

Sparks, badges, unlocks, collectible cards and similar virtual items exist only within Gina Heartwing. They are not money, cryptocurrency, stored value or a financial product; they cannot be redeemed for cash, transferred for value or used for wagering. We may adjust game balances, reward levels or virtual-item mechanics where reasonably required for gameplay, security or product development, provided that mandatory consumer rights are respected.

8. Purchases

Paid digital content, subscriptions, game unlocks, Sparks or physical products may be offered through our website, an app store or another authorised payment channel. Before a purchase, the customer will be shown the main characteristics, price, applicable taxes and material conditions of the product or service. App-store purchases may also be subject to the relevant platform’s terms.

9. Intellectual property

Gina Heartwing, Heartwing Hollow, character artwork, logos, stories, music, voices, animations, game names, game artwork, interfaces, software and other original content are protected by intellectual-property laws and remain the property of Heartwing Entertainment Ltd or the relevant licensor. No commercial reproduction, merchandise production, republication, scraping, extraction, model training, resale or creation of derivative commercial products is permitted without prior written consent.

10. Content created with Story Studio and Melody Maker

You may use Story Studio and Melody Maker for personal, family and non-commercial creative play. Any original words or musical choices supplied by you remain yours to the extent that they are independently protectable, but Gina characters, artwork, music assets, voices and other Heartwing elements remain Heartwing intellectual property. A saved film, song or creation containing Heartwing assets does not grant a right to commercially exploit those assets.

11. Acceptable use

You must not interfere with the service, bypass access controls, probe or attack our systems, introduce malicious code, reverse engineer protected software except where law expressly permits it, automate abusive requests, impersonate another person, infringe intellectual property, or use Gina Heartwing for unlawful or harmful purposes.

12. Availability and changes

We may update, improve, replace or discontinue features. We may temporarily suspend access for maintenance, security, legal compliance or technical reasons. Where a change affects paid digital content or services, applicable consumer rights and contractual obligations remain unaffected.

13. Third-party services

Some features may depend on app stores, payment processors, authentication providers, hosting providers or other third parties. Their own terms and privacy notices may apply to the services they provide.

14. Liability

Nothing in these Terms excludes liability that cannot lawfully be excluded, or limits statutory consumer rights. Subject to those rights, Gina Heartwing is provided for ordinary personal and family use and we are not responsible for indirect or consequential losses that were not reasonably foreseeable when the relevant contract was formed.

15. Governing law and jurisdiction

These Terms and any non-contractual obligations arising from them are governed by the laws of the Republic of Cyprus. For users acting in the course of business, the courts of the Republic of Cyprus have exclusive jurisdiction. For consumers, this clause does not deprive you of any mandatory protection or jurisdictional right that cannot lawfully be excluded under the law applicable to you.

16. Changes to these Terms

We may revise these Terms to reflect legal, technical or product changes. Material changes will be communicated in an appropriate way. The date at the top of this page shows the latest revision.
